Legal expert clarifies the validity of Saleh and Al-Kazemi to dissolve Parliament

“The Prime Minister’s visit to the President of the Republic today was to dissolve the House of Representatives? According to their joint authority without the need for approval from another party, since 64 / First of the constitution decided that there are two ways to dissolve the House of Representatives before completing its electoral cycle, that is, before completing the four years,” Harb said in a statement. .
And “the first parliamentary path when the parliament dissolves itself at the request of one-third of its members, that is, a request from 110 deputies followed by a vote by a majority of members, i.e. a vote and approval by 165 deputies to dissolve the parliament, and this is far because the deputies do not want to leave this characteristic and the privileges resulting from it.”
Harb pointed out that “the other way that the constitution decided to dissolve the House of Representatives is the executive method requested by the Prime Minister and the approval of the President of the Republic without the need for any approval from any other party, which means the Presidents of the Republic and the ministers to dissolve Parliament even if Parliament rejects the solution and this is clear from the letter {or} It is stated in Article 64 of the Constitution that states: “The House of Representatives is dissolved by an absolute majority of its members at the request of one third of its members {or} and this benefits the allowance and option – or a request from the Prime Minister and with the approval of the President of the Republic.”
He continued, “What is mentioned after {or} is the executive way to dissolve parliament when the Prime Minister and President of the Republic agree to dissolve the House of Representatives, and contrary to the parliamentary regulations that granted the Prime Minister to dissolve Parliament without the need for any other approval as the head of state as in Britain, Germany, Italy, India and South Africa, these countries It gave the prime minister the dissolution of Parliament without the need for the approval of another party. ”
“Did Al-Kazemi agree with Saleh to dissolve parliament now or after a period of known reasons, but what we know is that there is a constitutional authority set for them to dissolve the parliament without the need for approval from any other party,” he asked.
The President of the Republic, Barham Saleh, had received, Thursday, at the Peace Palace in Baghdad, Prime Minister Mustafa Al-Kazemi, and they confirmed, according to a presidential statement, “the need to expedite the completion of the ministerial cabinet by nominating efficient and impartial personalities, and support the government in implementing its program voted by the parliament by preparing for early elections.” , And to meet the legitimate demands of Iraqis to achieve the desired reform. ”
