The Secretariat of the Council of Ministers issued a clarification on the pensions of Iraqi officials

The Council of Ministers announced on Thursday that the decision of the Council of Ministers to stop the pensions of officials in the Iraqi government and senior officials is effective, and any decision not issued by the Federal Court cancels the decision.

Al-Aman said in a statement today that it is an explanation of what was stated in the letter of the Iraqi Council of Representatives, dated March 24, 2017, containing the request to suspend the work of the Council of Ministers Resolution No. (333) for the year 2015, And the presence of a decision of the Federal Supreme Court includes the cancellation of the decision of the Council of Ministers referred to above.

In this regard, the Secretariat of the Council of Ministers would like to clarify the following:

This Secretariat confirms that no decision has been issued by the Federal Supreme Court which includes the suspension of the aforementioned decision of the Council of Ministers.
Any violation by the executive branch, if any, shall be subject to appeal before the Federal Supreme Court or other competent courts. Whereas, those covered by the decision of the Council discussed before have been challenged by the Staff Court and before the Pensioners Affairs Review Board. Another person opposed to the aforementioned resolutions has no support from the law.
It is noteworthy that the decision of the Council of Ministers above included the suspension of the payment of pensions granted under the laws and previous decisions of those who held office after 9/4/2003 of officials and senior officials and re-calculation of their pensions with a pension service not less than (15) years and at least age (50) years in accordance with the provisions of Article (21) of the Unified Retirement Law No. (9) for the year 2014.
