Parliamentary Regions: Federal Court will end the debate over the powers of the provinces

BAGHDAD / Center Brief for the Iraqi Media Network (IMN) - Committee of the Regions and the provinces parliamentary said, Sunday, that she decided to use legal means to put pressure on the federal government to back down from the decision to suspend the transfer of powers from the ministries to the provinces, according to committee member Ahmed al-Badri.

Under article 45 of Law 21 of 2008 amended the Federal Government to take over the body through the upper Altenseeqh transfer to the provinces and ministries of eight federal powers to local governments cut the time-standing two years.

Badri said for (IMN) that "the Commission is waiting fifth history of next month, the last deadline set governorates not organized province of Law No. 21 of 2008 amending the transfer of powers from the relevant ministries to the provinces and in two years."

The Cabinet decided earlier to stop the transfer of powers from the ministries to the provinces soon after issued Resolution No. 62, who spent the formation of a committee to conduct new amendments to the governorates not organized province administration law.

Badri added that "in the event of non-compliance with the relevant ministries to the time limit determined in accordance with the law, which expires in 5 of next month, the Parliamentary Committee of the Committee of the regions will resort to to challenge the government's decision to suspend the transfer of powers to the provinces of the Federal Court."

And he announced many of the provincial government for its refusal to the proposal to postpone the transfer of powers to the provinces for another two years, and the Baghdad Provincial Council recently decided to withdraw from the meetings of the Higher Coordination Committee for the provinces to protest the government proposal.

Badri and that "the transfer of powers to the provinces will accelerate the pace of the delivery of services to citizens and end the routine practice by the federal ministries as well as it will eliminate the reluctance of many of the projects implemented by ministries in the provinces."

He said Adviser to the President of the Republic for Provincial Affairs Torhan Mufti, earlier that stop the transfer of powers to the provinces in accordance with the Act 21 of 2008 a legal error rate, indicating that the decision of 62 approved by the Council of Ministers, he can not legally stop the application of applicable law.
