    Announced the President of the Kurdistan Regional Government Nechirvan Barzani said tensions between Baghdad and Erbil does not serve the interests of the region or the interests of Iraq.

    CHAPTER VII: ACTION WITH RESPECT TO THREATS TO THE PEACE, BREACHES OF THE PEACE, AND ACTS OF AGGRESSION

    Article 39

    The Security Council shall determine the existence of any threat to the peace, breach of the peace, or act of aggression and shall make recommendations, or decide what measures shall be taken in accordance with Articles 41 and 42, to maintain or restore international peace and security.

    Article 40

    In order to prevent an aggravation of the situation, the Security Council may, before making the recommendations or deciding upon the measures provided for in Article 39, call upon the parties concerned to comply with such provisional measures as it deems necessary or desirable. Such provisional measures shall be without prejudice to the rights, claims, or position of the parties concerned. The Security Council shall duly take account of failure to comply with such provisional measures.

    Article 41

    The Security Council may decide what measures not involving the use of armed force are to be employed to give effect to its decisions, and it may call upon the Members of the United Nations to apply such measures. These may include complete or partial interruption of economic relations and of rail, sea, air, postal, telegraphic, radio, and other means of communication, and the severance of diplomatic relations.

    Article 42

    Should the Security Council consider that measures provided for in Article 41 would be inadequate or have proved to be inadequate, it may take such action by air, sea, or land forces as may be necessary to maintain or restore international peace and security. Such action may include demonstrations, blockade, and other operations by air, sea, or land forces of Members of the United Nations.

    Article 43
    1. All Members of the United Nations, in order to contribute to the maintenance of international peace and security, undertake to make available to the Security Council, on its call and in accordance with a special agreement or agreements, armed forces, assistance, and facilities, including rights of passage, necessary for the purpose of maintaining international peace and security.
    2. Such agreement or agreements shall govern the numbers and types of forces, their degree of readiness and general location, and the nature of the facilities and assistance to be provided.
    3.The agreement or agreements shall be negotiated as soon as possible on the initiative of the Security Council. They shall be concluded between the Security Council and Members or between the Security Council and groups of Members and shall be subject to ratification by the signatory states in accordance with their respective constitutional processes.

    Article 44

    When the Security Council has decided to use force it shall, before calling upon a Member not represented on it to provide armed forces in fulfilment of the obligations assumed under Article 43, invite that Member, if the Member so desires, to participate in the decisions of the Security Council concerning the employment of contingents of that Member's armed forces.

    Article 45

    In order to enable the United Nations to take urgent military measures, Members shall hold immediately available national air-force contingents for combined international enforcement action. The strength and degree of readiness of these contingents and plans for their combined action shall be determined within the limits laid down in the special agreement or agreements referred to in Article 43, by the Security Council with the assistance of the Military Staff Committee.

    Article 46

    Plans for the application of armed force shall be made by the Security Council with the assistance of the Military Staff Committee.

    Article 47
    1. There shall be established a Military Staff Committee to advise and assist the Security Council on all questions relating to the Security Council's military requirements for the maintenance of international peace and security, the employment and command of forces placed at its disposal, the regulation of armaments, and possible disarmament.
    2.The Military Staff Committee shall consist of the Chiefs of Staff of the permanent members of the Security Council or their representatives. Any Member of the United Nations not permanently represented on the Committee shall be invited by the Committee to be associated with it when the efficient discharge of the Committee's responsibilities requires the participation of that Member in its work.
    3. The Military Staff Committee shall be responsible under the Security Council for the strategic direction of any armed forces placed at the disposal of the Security Council. Questions relating to the command of such forces shall be worked out subsequently.
    4.The Military Staff Committee, with the authorization of the Security Council and after consultation with appropriate regional agencies, may establish regional sub-committees.

    Article 48
    1. The action required to carry out the decisions of the Security Council for the maintenance of international peace and security shall be taken by all the Members of the United Nations or by some of them, as the Security Council may determine.
    2.Such decisions shall be carried out by the Members of the United Nations directly and through their action in the appropriate international agencies of which they are members.

    Article 49

    The Members of the United Nations shall join in affording mutual assistance in carrying out the measures decided upon by the Security Council.

    Article 50

    If preventive or enforcement measures against any state are taken by the Security Council, any other state, whether a Member of the United Nations or not, which finds itself confronted with special economic problems arising from the carrying out of those measures shall have the right to consult the Security Council with regard to a solution of those problems.

    Article 51

    Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defence shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.

    AGREEMENT REACHED TO EASE IRAQ'S CRISIS

    BAGHDAD - Top federal and Kurdish security officials agreed in Baghdad on Monday to “activate” coordinating committees between their forces and work to calm the situation in northern Iraq, a statement said. Tensions are running high in parts of the country’s north that the autonomous Kurdistan region wants to incorporate over the strong objections of Baghdad, and military reinforcements have been sent to disputed areas. Parliament speaker Osama al-Nujaifi has been pushing to resolve the crisis between Baghdad and Kurdistan, which he has warned could lead to civil war.

    The two sides agreed to continue meeting “and to activate the higher coordinating committees between the (federal) armed forces and the (Kurdish) regional guard forces” known as peshmerga, a statement from military spokesman Colonel Dhia al-Wakil said, without providing details on the committees.

    They also agreed to begin “calming the situation and searching for mechanisms to withdraw the units that were mobilised after the crisis to their former locations,” the statement said.

    The meeting was chaired by national security adviser Falah al-Fayadh and attended by Iraqi General Faruq al-Araji, US Lieutenant General Robert Caslen and delegations from the federal defence ministry and the Kurdistan ministry responsible for the peshmerga forces, it said.

    The peshmerga ministry’s media office said the Kurdish delegation included top peshmerga officials Jabbar Yawar and Anwar Haj Othman, though confirmation of the agreement was not immediately available from the Kurdish side.

    Nujaifi has been holding talks since Wednesday with political leaders in Baghdad and Kurdistan in a bid to reduce tensions.

    Earlier on Monday, Kurdistan premier Nechirvan Barzani told a news conference that “Iraq’s problems will not be addressed by force” and “will only be addressed by dialogue”.

    Barzani also said a high-level Kurdish delegation would travel to Baghdad on Tuesday for meetings, and expressed hope that Nuajifi’s efforts would yield results.

    The recent establishment of the Tigris Operations Command, which covers disputed territory in the north, drew an angry response from Kurdish leaders who want to incorporate much of the area into their autonomous region.

    Kurdistan president Massud Barzani said peshmerga clashed with Iraqi forces in the disputed town of Tuz Khurmatu on November 16, after which he ordered the peshmerga to be in “a highest state of readiness”.

    Iraqi Prime Minister Nuri al-Maliki’s office warned the peshmerga “not to change their positions or approach the (federal) armed forces,” and the two sides traded accusations about reinforcements being deployed.

    The territory row poses the biggest threat to Iraq’s long-term stability, diplomats and officials say. Ties between the two sides are also marred by disputes over oil and power-sharing.

    Tension Easing after Standoff between Peshmerga and Iraqi Troops in Dibis

    The latest flare up led to a one-hour clash between the two sides in the town of Dibis.

    SULAIMANI, Kurdistan Region—Tensions are beginning to ease after a week-long standoff between Peshmerga forces and Iraqi troops in the disputed territories of Diyala and Kirkuk. However, heavy weaponry and forces still remain in the area.

    After the 2003 liberation of Iraq, tensions have broken out several times between the Peshmerga and Iraqi forces while Iraqi Prime Minister Nuri al-Maliki has been in power.

    The latest flare up led to a one-hour clash between the two sides in the town of Dibis.

    Burhan Rashid, an MP from the Change Movement (Gorran) in Kurdish Parliament, expressed doubts about Maliki’s recent message to Kurdistan President Massoud Barzani regarding the formation of the joint forces both sides agreed to in 2009.

    “This is a desperate call. Maliki won’t hesitate to carry out this war, as soon as he knows for sure that he can defeat the Peshmerga,” Rashid said. “The Kurdish authorities must insist on dissolving the Dijla Operations Command and shouldn’t allow it to enter the Kurdish areas.”

    “More than 200,000 Iraqi troops have been sent to the front line with the Peshmerga, along with heavy weaponry that the government obtained after 2003,” Rashid told Rudaw.

    “According to Article 9 of the Iraqi constitution, Maliki’s actions -- moving the army for in response to a domestic political dispute -- are illegal,” he said, adding that appointing military commanders is another illegal action by Maliki.

    Fazil Basharati, a member of the Peshmerga committee in Kurdish Parliament, believes that sooner or later war will break out between the Peshmerga and Iraqi troops and that that will be the only way to settle the issue of the disputed territories.

    “The sooner we go to war, the better,” Basharati said. “The Peshmerga have the same capacity as the Iraqi military in the disputed territories.”

    Basharati described the situation on the front line as “very tense.”

    However, Shalal Abdul, the mayor of Dibis, said that the situation is now “normal.”

    “There are a large number of Iraqi forces with 140 tanks in the area, but they have not entered the town,” Abdul said.

    Abdul said that it is less likely clashes will break out since a large number of Peshmerga forces are in the area and can control the situation in just two hours.

    Shwan Taha, a member of the interior and security committee in Iraqi Parliament, dismissed allegations that Kurdish members of his committee have been silent about Maliki’s actions.

    “Maliki doesn’t care about parliament’s demands nor does he care about being held accountable to them,” he said.

    Taha said that he and Hassan Jihad, another Kurdish MP, boycotted the committee’s meeting after everyone else approved Maliki’s actions and the way he handled the situation.

    The disputed territories include the provinces of Kirkuk, Diyala and Nineveh. So far, the situation has been calm in Nineveh province, while it is a different story in Kirkuk and Diyala.

    A security source from Khanaqin told Rudaw that, after Peshmerga forces gathered in the area, the Iraqi government sent in a battalion with heavy weaponry.

    Peshmerga officials in the area told Rudaw that so far, no suspicious activity has been detected and their forces will stay as long as they are needed.

    Since the beginning of the recent events, groups of people from the Kurdistan Region have been visiting Peshmerga on the front lines and expressing their support on social network sites.

    Abdulla Jabar posted on Facebook that he is “ready to go fight along with the Peshmerga.”

    Baghdad/ NINA /--Delegations of Ministries of Defense and Kurdish Peshmerga forces held a second meeting today.

    The Iraqi satellite semi official TV channel reported today's meeting comes to complete outstanding issues of yesterday's meeting, which was held between the two sides.

    Both sides agreed in yesterday meeting to withdraw troops that redeployed in the disputed areas after the current crisis and return back to their previous localities./
