    MONTREAL, Canada — The recent seizures of swaths of land by the Kurds and Sunni insurgents in Iraq has called into question borders that were drawn nearly a century ago. Since the Islamic State of Iraq and Syria (ISIS) launched its assault on the Iraqi city of Mosul in early June, Iraq has effectively been partitioned.



    Jihadist-led Sunni rebels proclaimed a “caliphate” stretching from Aleppo in Syria to Diyala, northeast of Baghdad, while Kurdistan Region President Massoud Barzani signaled the Kurds would take steps towards independence including new territories Kurdish fighters seized in the north. Iraq’s Shia prime minister, Nouri al-Maliki, has been left in control of Baghdad and of the south.



    Iraq was carved out under the secret 1916 Sykes-Picot agreement, through which the British and French partitioned their respective spheres of influence after World War I.

    “It is not so much up to us to re-consider how these borders were originally drawn, as much as it is up to us to accommodate ourselves to the changes that are now occurring particularly in Syria and Iraq involving the Kurds and the lines of separation between the Sunni and Shiite,” Gunter maintained.



    The secret accord initially aimed to secure French and British trade and oil interests along with creating artificial nation-states, which proved problematic early on.



    “No place in the Middle East is truly homogeneous and one of the big challenge of creating national boundaries is that those minorities need to be integrated or they suffer repression,” Howard Eissenstat, history professor at the University of St-Lawrence in New York and an expert in the late Ottoman Empire, told Rudaw in a phone interview.



    The recent territorial claims by Sunni insurgents and the open Kurdish pursuit of independence are perhaps the biggest threat Iraq’s unity — and the Sykes-Picot agreement — since the nation was conceived.



    “With the collapse of the political orders in many states — particularly in Syria, Iraq and Libya — the notion of the nation-state has come tremendous pressure. It is now very likely that these states can be altered by internal forces from within these countries and by trans-border cooperation between armed groups,” Salih said.



    Baghdad is now caught between the Kurds and ISIS, which have no interest in Iraq’s unity. Barzani, the president of the autonomous Kurdish region, is moving forward with the plan for statehood as Baghdad fails to shift its policy toward Erbil or deliver the Kurdistan Region’s budget, which Baghdad cut in January over oil disputes.



    “Until recently, an independent state of Kurdistan was considered beyond the pale because it seemed to threaten the territorial integrity of the existing states. However, in recent years, the region has had plenty of time to adjust to the idea of Kurdish empowerment and with the seemingly collapse of Iraq and Syria as we knew them, at least independence for the KRG,” Gunter told Rudaw.

    Last week the Kurdistan Region’s Parliament passed a law to create an electoral commission independent of Baghdad, paving the way for a referendum on Kurdish independence.



    Yet unless it becomes more moderate, the extremist ISIS militia “in theory threatens all the existing states in the Middle East, possibly the KRG and Israel even more than the Arab states, because the KRG and Israel are not Arab,” Gunter said.



    “Although changes in the existing borders in favor of the KRG and Sunnis in Iraq and Syria now seem inevitable, too many changes too quickly would probably lead to instability,” Gunter warned.

    ERBIL, Kurdistan Region – The Kurdistan Region’s energy minister said Wednesday that Iraq has filed a lawsuit in the United States to seize Kurdish oil on a tanker anchored in the Gulf of Mexico, but that it “cannot win.”


    “The KRG’s lawyers sent a letter to a court in Texas to explain the misrepresentations of the Iraqi federal government,” said Ashti Hawrami, minister of natural resources in the Kurdistan Regional Government.

    “The Iraqi federal government has petitioned a Texas court for an order to seize crude oil legally produced, exported, and sold by the KRG in accordance with the Iraqi constitution and law. The letter indicates the possibility of massive counterclaims against the federal government,” Hawrami said in a statement on the KRG’s website.



    “The federal government of Iraq is trying to achieve in foreign courts and in the Iraqi Supreme Court what is denied to the federal government by the Iraqi constitution,” Hawrami said.



    “The federal government cannot win, because our crude is legally produced, shipped, exported, and sold in accordance with the rights of the Kurdistan Region as set forth in the Iraqi constitution,” the minister added.



    “Our claims for unpaid compensation, which must be paid as provided in the Iraqi constitution and the law, will also be before any foreign court in which the federal government is seeking to attack us,” Hawrami warned.



    His comments came after a US judge refused permission to the United Kalavrvta tanker to unload its cargo of Kurdish crude in the United States.



    Federal magistrate Nancy K. Johnson said the tanker is not under the jurisdiction of the United States, given that it is outside territorial waters and is not permitted to unload its cargo.



    The dispute over the shipment, which was some 100 kilometers offshore Texas, should be resolved in Iraq between the Iraqi government and the Kurdistan autonomous region, Johnson said.



    On Monday, the judge issued an order for US Marshals to seize the one million barrels of crude from the United Kalavrvta, but later decided that was not enforceable.



    Also on Monday, lawyers representing the Iraqi government filed a lawsuit saying the Kurds had sold the oil without permission from the central government, Reuters reported.

    Johnson has scheduled a conference for the two sides to present their case.



    Lawyers said the tanker could sail away, or offload its cargo for delivery at another US Gulf of Mexico port outside of Texas.



    Iraq’s Oil Ministry has threatened to sue anyone who purchases oil from the Kurdistan Region after the KRG struck deals to sell crude oil via Turkey without first receiving Baghdad’s approval. The KRG has accused Baghdad of using bullying tactics to stop its oil sales and maintains that it will only keep the 17 percent share of the oil revenue sales, in line with the Iraqi constitution.



    The United States has warned against purchasing crude oil from Iraqi Kurdistan because of the potential legal implications from Baghdad. The United Leadership tanker carrying Kurdish crude appeared to be bound for the US in June but ended up in Morocco.



    Marie Harf, deputy spokesperson for the State Department, told Rudaw that the State Department does not necessarily deem sales of crude oil from Iraqi Kurdistan illegal, but “there’s a legal dispute process here, an arbitration mechanism. There will be a legal ruling on it.”



    Landing crude in the US is an important issue for Iraqi Kurdistan, which is trying to establish its own oil trade and is in dire need of revenue since Baghdad cut the region’s funding in January.



    The feud worsens as Baghdad-Erbil relations are already at rock bottom, and the Kurds are planning an independence referendum to break away from Iraq.

    On July 22, the Egyptian Salafist sheikh Talaat Zahran declared that it is inappropriate to aid the people of Gaza because they do not follow a legitimate leadership, and because they are equivalent to Shiites since they follow them, referring to Hezbollah and Iran, with which the Sunni Hamas movement has been allied. Thus the jihadists' position is not simply a political stance, but stems from Salafist theological principles.

    Salafists believe that jihad must be performed under legitimate leadership. This argument is advanced through the “banner and commander” concept, which holds that whoever undertakes jihad must follow a commander who fulfills the criteria of religious and political leadership and has raised the banner of jihad. Given that there is neither a legitimate leader nor a Salafist-approved declaration of jihad in Palestine, fighting there is forbidden.

    In addition, for Salafists, if non-Muslims control Islamic countries and apostates exist in the Islamic world, the Islamic world must be cleansed of them before all else. In short, the purification of Islamic society takes priority over combat against non-Islamic societies. On this basis, Salafists see conflict with an allegedly illegitimate Hamas government as a first step toward confrontation with Israel. Should the opportunity for military action present itself in the Palestinian territories, Salafists would fight Hamas and other factions deemed in need of “cleansing” from the land and engage Israel afterward.

    Salafists today see that their priority as fighting Shiites, “munafiqin” (dissemblers, or false Muslims) and apostates, whom they call the “close enemy.” During the current war in Gaza, a number of IS fighters have burned the Palestinian flag because they consider it a symbol of the decline of the Islamic world, which succumbed to national divisions through the creation of independent political states. In Salafist doctrine, the entire Islamic world must be united under a single state, an Islamic caliphate, which IS declared in late June.

    Salafist groups active in Gaza have engaged in various rivalries with Hamas there, but they have not succeeded in establishing a foothold of any significance. Some groups have posted video clips acknowledging their support for IS following the group’s recent victories in Iraq and Syria. The main dispute between Hamas and Salafist groups rests on their disparate principles. Hamas is more realistic and pragmatic than the jihadist Salafists. The former has political priorities in liberating Palestinian land, whereas the latter has religious priorities in the establishment of a totalitarian Islamic caliphate and considers the Israeli issue secondary to this central goal.
