    Kurdistan Strives for Better Data, as Economy and International Interest Grow

    If Kurdistan were a country it would rank as the 103rd biggest economy in the world.

    ERBIL, Kurdistan Region - The Kurdistan Region Statistics Office (KRSO) expects the release of a new Gross Domestic Product (GDP) figure by the end of July.

    The last survey was conducted in 2011, when it was determined that the region’s economic activity amounted to $20 billion. A year before, the KRG claimed 5.2 million people lived in the region.

    If Kurdistan were a country it would rank as the 103rd biggest economy in the world, according to the International Monetary Fund’s (IMF) 2011 GDP index. It would come in above Nepal (a country of 27.2 million people) and Zambia (13.6 million), but below Estonia and Trinidad and Tobago (both 1.3 million).

    This said, a prominent business figure working in Kurdistan expressed doubts about the past calculations. “These numbers are not reliable,” he said, “as they can’t get an accurate account of the hugely important ‘grey economy.’”

    The grey economy is an informal economy of unrecorded cash transactions. A substantial volume of businesses are able to circumvent the already limited tax code in the country, so most economic activity lies “off the books.” This makes it extremely difficult to calculate GDP, along with a range of other information about the economy.

    The situation has not been helped by budget cuts in Baghdad, as Iraqi Prime Minister Nuri al-Maliki piles the pressure on Erbil by cutting off federal funding.

    KRSO President Serwan Muhammed Muhialdeen claims that almost half of the office’s $8.6 million dollar budget will be affected by cuts. The remaining funds will cover salaries, but little more. This is catastrophic for the office, as rigorous studies are extremely resource-intensive, not to mention time consuming.

    There is some cooperation with the central government. The KRSO cooperates with the Central Statistics Office in Baghdad, from whom it receives funding for special surveys. A recent example is a project to collect tourism industry data.

    Dr. Jamal Ameen, a senior statistician at the region’s Ministry of Planning and professor of statistics in the UK, stresses that Kurdistan is still young and changing rapidly. Slowly but surely, he believes, their data are rising to “global standards,” aided by these partnerships with international organizations.

    He notes that the KRG has a $100 million fund to send students and government employees abroad for advanced degrees in fields like statistics. When they return, as they are contractually obliged to, it is hoped they will bring cutting edge knowledge and methodology.

    The professor knows solid numbers are important to bring international investment and attention. Outsiders will need reliable facts to measure the incredible progress the Kurds are making -- almost entirely by themselves.

    ERBIL, Kurdistan Region—A decade of conflict and violence has led many residents of the Iraqi province of Anbar to think that an autonomous region similar to what the Kurds enjoy in the north might be the best solution. Though some believe they have missed the opportunity.

    “You cannot compare the status of Anbar with that of the Kurdistan Region,” says Salam al-Khalid, a journalist based in Fallujah. “Anbar must be run by qualified elites, academics, and experienced politicians in order to catch up with Kurdistan.” Al-Khalid laments the situation in his province where indiscriminate arrests, bombings and violence have become part of life. He says that the incompetence of the Sunni leaders isn’t making their situation any better. “It’s not feasible for Anbar to be governed by clans and armature politics that are unable to solve complex problems the region is suffering from,” he says. He believes that the ultimate solution is autonomy.

    However, says al-Khalid, the first step towards a Sunni autonomous region is to get Prime Minister Nuri al-Maliki out of the way as he is a big obstacle for such an ambition. “The current viable solution is to vote out Maliki in the next election,” he says. “You must get rid of the current political system based on quotas, sectarianism, factionalism then one must think of forming an autonomous region because as long as Maliki is in power it’s hard to make such crucial decision to declare an autonomous region.”

    Al-Khalid believes that contrary to some analysis, Anbar wouldn’t be a poor region if it decided to split from the central government. “We have minerals, human resources, the Euphrates River, natural gas, tourism and oil,” he says. Some residents blame the dire situation in Anbar on the endless conflict that has been raging the area since the US invasion in 2003.

    A plenary consideration and discussion of it's meaning follows. The rule of law is an ambiguous term that can mean different things in different contexts. In one context the term means rule according to law. No individual can be ordered by the government to pay civil damages or suffer criminal punishment except in strict accordance with well-established and clearly defined laws and procedures. In a second context the term means rule under law. No branch of government is above the law, and no public official may act arbitrarily or unilaterally outside the law. In a third context the term means rule according to a higher law. No written law may be enforced by the government unless it conforms with certain unwritten, universal principles of fairness, morality, and justice that transcend human legal systems.

    The rule of law requires the government to exercise its power in accordance with well-established and clearly written rules, regulations, and legal principles. A distinction is sometimes drawn between power, will, and force, on the one hand, and law, on the other. When a government official acts pursuant to an express provision of a written law, he acts within the rule of law. But when a government official acts without the imprimatur of any law, he or she does so by the sheer force of personal will and power.

    The rule of law also requires the government to exercise its authority under the law. This requirement is sometimes explained with the phrase "no one is above the law." Members of the state and federal judiciary face a slightly different problem when it comes to the rule of law. Each day judges are asked to interpret and apply legal principles that defy clear exposition. Terms like "due process," "reasonable care," and "undue influence" are not self-defining. Nor do judges always agree about how these terms should be defined, interpreted, or applied. When judges issue controversial decisions, they are often accused of deciding cases in accordance with their own personal beliefs, be they political, religious, or philosophical, rather than in accordance with the law.

    A conundrum is presented when the government acts in strict accordance with well-established and clearly defined legal rules and still produces a result that many observers consider unfair or unjust. In other countries the political leaders assert that all written laws must conform with universal principles of morality, fairness, and justice. These leaders argue that as a necessary corollary to the axiom that "no one is above the law," the rule of law requires that the government treat all persons equally under the law. Yet the right to equal treatment is eviscerated when the government categorically denies a minimal level of respect, dignity, and autonomy to a single class of individuals. These unwritten principles of equality, autonomy, dignity, and respect are said to transcend ordinary written laws that are enacted by government.
