With such absolute privileges, he cannot possibly hint at the implication of Iraqi politicians in acts of violence without providing evidence and proof.

    When asked about the reason behind his reluctance to presenting these files to the judiciary, he answered, “I am concerned about the collapse of the political process if I do that.”

    In light of this, a question poses itself: If the prime minister confirms his possession of legal files and refuses to submit them to the judiciary, what, then, will be left of respect for the law?

    Maliki’s supporters answer this question by saying that “the accusations are directed against the members of Parliament and politicians who are involved in acts of terrorism that are still under investigation and cannot be published yet.”

    An even more perplexing question comes to mind immediately: How can the prime minister threaten with cases that are still judicially incomplete and have not become clear and final accusations yet? Does the head of the executive authority have the right to interfere in the work of judicial committees and pre-empt the revelation of cases and accusations — a role that is strictly reserved to the judiciary?

    This debate is justified by the persistent vagueness surrounding the performance of authorities in Iraq — a vagueness that expands the circle of distrust between these authorities. The executive authority believes that the terrorism files that are part of the judiciary’s responsibility constitute an ideal way of applying pressure on the legislative authority, which, in turn, aims to topple the prime minister and his political bloc before the elections. To do that, security violations are made, while Maliki is being accused of controlling the judiciary. As for the latter, it seems helpless in the face of all this pressure, and it is surrendering to the constant abuses of its powers and not saying so much as one word regarding national and international criticism of its performance.

    A nation cannot be built on doubts, accusations and mutual finger pointing, even if the pretext is an electoral battle. In fact, electoral campaigns do have limits that do not go beyond the legal considerations of accusations. Moreover, accusations related to involvement in terrorism cases cannot be mentioned in the context of insinuations and statements and out of their legal and legitimate framework.

    Of course, the Iraqi politicians’ degree of involvement in acts of violence is high. However, at the end of the day, these acts have neither been placed in a strict legal framework nor referred to the judiciary — which, ironically, is the only solution to reach a decision.
